Pembroke Isles : Florida geo-domain salvaged at UDRP

Pembroke Isles dot com is a geographically descriptive domain, registered in 1999 according to DomainTools.

The area is a residential development in the Pembroke Pines region, in beautiful – and hot – South Florida.

After 17 years of use by a community resident and Realtor, the domain PembrokeIsles.com was challenged at a UDRP by Pembroke Isles Homeowners Association, Inc. of Pembroke Pines, Florida.

The Complainant in this case claimed use of the PEMBROKE ISLES mark since 1994, but obtained registration of the mark on February 11, 2015. They operate from PembrokeIsles.org.

The Respondent is a real estate broker who is one of the original homeowners in the “Pembroke Isles” development, residing there since 1996.

According to the UDRP, the Respondent has used the Domain Name for fifteen years in connection with her real estate brokerage services, which are conducted in the name of her company, Luz Velez-Cardamone, P.A.

Currently, the domain is pointing to her corporate name, and while this is not the best way to ensure the non-contesting of its use, not to mention effective SEO, the Panelist delivered a decision in favor of the Respondent.
