WalMart.Horse : Artist served with a C&D letter over domain name

Jeph Jacques is the proud owner of Walmart.Horse, a domain and single page web site featuring a horse superimposed atop the photo of a Walmart store.

The mega-corporation with billions in assets, sent the cartoonist registrant a Cease & Desist “nastygram“, asking him to surrender the domain name:

“You have registered, without Walmart’s permission or authorization, the domain name(s) ‘walmart.horse’.  The Domain Name incorporates the well known Walmart mark in its entirety, and, by its very composition, suggests Walmart’s sponsorship or endorsement of your website and correspondingly, your activities.”

Jacques claims that the domain is used in a manner that constitutes fair use, through depiction of a parody scene. He is willing to provide a disclaimer on the web site stating exactly what his creation is all about.
