Consuela LLC is now tagged as a “reverse domain name hijacker.”

A case decided at the National Arbitration Forum is adding yet another domain to the expanding list of “reverse domain name hijackers” maintained by Rick Schwartz.

The domain name Consuela.com was registered in 1999; a company by the name of Consuela LLC claimed to have used the mark since 2006.

Consuela.com displayed adult themed content since at least 2005, according to Screenshots.com; the Internet Archive Wayback Machine extends that period to at least 2002.

The Complainant operates from ConsuelaStyle.com, and is based in Austin, Texas.

We often wonder what type of chronological disorder takes over the Complainants in such cases! Simply put, if the domain was registered years before the Complainant’s mark was used, they are attempting to steal it away from its registrants!

And that’s exactly what the three member panel found:

“The Panel finds that the Complainant attempted to engage in Reverse Domain Name Hijacking.”

Prominent IP attorney, Ari Goldberger of Esqwire.com Law Firm, New Jersey adds yet another notch to his belt of successful cases, while Rick Schwartz will be adding that same notch on his domain hijacker “wall of shame.” 😀
