UDRP hits dot .guru registrant as QLIKVIEW trademark gets enforced

TM dilution is not the business of a UDRP

TM dilution can lead to a UDRP for a domain.

Let’s face it: if you don’t enforce your trademark, there is a risk that it will become obsolete.

This is the case with QLIKVIEW, a trademark owned by the Swedish software company, QlikTech International AB, operating from Qlik.com.

The company entered their mark to the Trademark Clearinghouse in November 2013, and sure enough they received notification of the registration of qlikview.guru.

The Respondent did not properly respond, in the sense of submitting a defense statement; instead, they argued about how they are not familiar with the English language, being German. They also claimed they did not offer the domain for sale and expressed their lack of knowledge about how their domain violated the QLIKVIEW trademark.

Well, doh.

Unfortunately for the Respondent, such statements do not serve as a response, and the sole panelist, Tobias Zuber Buhler, decided that the domain qlikview.guru should be handed over to the Complainant.
