<p>Perhaps the <a href="http://bits.blogs.nytimes.com/2010/02/13/chatroulettes-founder-17-introduces-himself/?src=twt&amp;twt=nytimesbits" target="_blank"><strong>17 year old Russian</strong></a> who created the web site in order to randomly pair video conferencing individuals around the world, could not have predicted it&#8217;d take off so quickly &#8211; <em>at least, among the ever expanding community of video exhibitionists.</em></p>
<p>But even if an exhibitionist attempts to violate the visuals of a stranger, hidden behind the anonymity offered by the lack of any login credentials, the ChatRoulette culture has apparently become the elite gathering point of masturbating males.</p>
<p>After loading up the web page and setting up your camera to send and receive video and audio, chances are that 24 times out of 25 you will be connecting with a guy; or more accurately, with a naked, jerking off guy in half of these instances &#8211; who displays no regard as to who will be on the other end of the connection.</p>
<p>You&#8217;ve been warned.</p>

<p>A solid domain &amp; underlying technology sale has been reported on <a href="http://mashable.com/2010/03/09/retweet-com-sells-for-250000/" target="_blank"><strong>Mashable</strong></a> and announced by <a href="http://www.domainnamenews.com/up-to-the-minute/retweet-com-sells-for-250000/7288" target="_blank"><strong>DNN</strong></a>; the sale occurred on <a href="http://flippa.com" target="_blank"><strong>Flippa</strong></a> &#8211; a selling platform that mainly caters to developed web sites.</p>
<p>The apparent sale &#8211; which still needs to be confirmed &#8211; was for a staggering <a href="http://flippa.com/auctions/85167/bids" target="_blank"><strong>$250,000 dollars</strong></a>. A bidder took advantage of the BIN (buy it now) price and thus leapfrogged the previous offer of $202,000.</p>
<p>What makes this case really interesting, is the existence of not one but <strong>two pending trademark applications for &#8220;retweet&#8221;</strong> for several months now.</p>
<p>Let&#8217;s look at them in more detail.</p>
<p><strong>retweet: Trademark Application 1 &#8211; </strong>Filed on August 14, 2009 by Twitter Inc.</p>
<blockquote><p>IC  038.  US 100 101 104.  G &amp; S: transmission of messages; electronic message sending, receiving and forwarding; telecommunications services, namely, providing online and telecommunication facilities for real-time interaction between and among users of computers, mobile and handheld computers &#8230;</p></blockquote>
<p>The current status as of March 1, 2010 indicates that <span style="color: #000000;">&#8220;<em>an office action suspending further action on the  application has been mailed.</em>&#8221; What that means is, that there is no final decision. Instead, the letter says:</span></p>
<blockquote><p><em>Since applicant&#8217;s effective filing date is subsequent to the effective filing date of the above-identified application(s), the  latter, if and when it registers, may be cited against this application in a  refusal to register under Section 2(d) of the Trademark Act, 15 U.S.C. §1052(d).</em></p></blockquote>
<p>In other words, the letter describes other pending trademark / service mark applications that are related to that by Twitter. These applications ARE NOT for &#8220;retweet&#8221; but instead for:</p>

<p>As you can see, that&#8217;s quite a handful of pending applications that contain &#8220;tweet&#8221; which are considered clashing as they are in overlapping product or service classes. Looks like a clusterf@ck from here.</p>

<p>The current status of September 18, 2009 indicates that &#8220;<em>A non-final action has been mailed. This is a letter from the examining attorney requesting additional information and/or making an initial refusal. However, no final determination as to the registrability of the mark has been made.</em>&#8221;</p>
<p>The letter itself indicates &#8211; as with Twitter&#8217;s application &#8211; that there are other pending applications and that confusion would be caused if the applicant retained the overlapping classes, in this case IC 041.</p>
<p>Our guess is that, given the proximity of the status update of the tm application by Twitter (March 1, 2010) the bidder of the $250,000 amount for Retweet.com is Twitter Inc. By obtaining a high-traffic domain and service closely related to their services and pending trademark application, they are adding weight to their pending &#8220;retweet&#8221; application against the second applicant. Double whammy!</p>

<p>Many domain owners invest in useless new TLDs not realizing that the real money remains with com/net/org domains. Instead of flushing money down the toilet, they are advised to follow the paradigm.</p>
<p>In a shocking admission, ICANN spokesperson Betty Sukrum stated that ICANN is opening the market to hundreds of new gTLDs but is not willing to hold the hand of those who intend to invest in this business.</p>

<p>The summary of it is at the end of page 2 and one needs to read between the lines of the report to obtain it; a difficult task, as it&#8217;s laden with photographs of happy faces.</p>
<p>A strange mix of emotions is obtained after seeing the faces from the early domain conference years; several of which are recognizable from recent events as frequent &#8211; or serial &#8211; participants.</p>
<p>The truth is that no matter how one would like to polish the participation and other financial figures and remain optimistic about the future outlook of the domain industry&#8217;s social gatherings, <strong>the current situation is critical.<br />
</strong></p>
<p><strong>It&#8217;s simply impossible to sustain a healthy momentum </strong>when the number of domainer conferences each year almost matches the number of months!</p>
<p><strong>The original mystique, authenticity and expectation</strong> of a handful of events is watered down once the number of events becomes uncomfortably high; right now we are <strong>heading beyond the edge.</strong></p>
<p>As a social gathering opportunity, each domain conference must offer<strong> something distinctively different</strong> to its participants, advertisers and sponsors in order to be considered successful. The tight schedule in-between conferences makes it difficult for willing participants to select several in advance; on the other hand, for financial reasons and for practical reasons, event planners cannot provide these schedules well in advance.</p>
<p><strong>An obvious and dangerous Catch-22.</strong></p>
<p>For the past several months, the state of &#8220;<em>bad economy</em>&#8221; has created a stronghold around the neck of every industry, including domaining.</p>
<p>While there is a need for entrepreneurs to converge and join forces, creating multiple and similar meeting venues without a solid plan is clearly becoming a non-practical approach; no matter how nostalgic one wants to remain about the early days of domain conferencing.</p>
<p>The bottom line is that the domain industry must rediscover its methods, structure and objectives and be very selective of the personas it lends an open microphone to, as authority spokespersons.</p>
<p><strong>Otherwise, there will be blood.</strong></p>

<p>The Kilimanjaro expedition of domainers has returned to base, according to <a href="http://dnjournal.com/lowdown.htm" target="_blank"><strong>DNJournal</strong></a>.</p>
<p>With 26 climbers out of 27 making it to the Kilimanjaro summit, one is gone missing.</p>
<p>Various sources cite that <strong>Boris Doofus</strong> of Ukraine, a domainer with extensive climbing background, was not among those that are currently warming up their legs, arms and other body parts around a camp fire by the shadow of mount Kilimanjaro.</p>
<p>The latest GPS report shows Boris in the <strong>Himalayas </strong>region, somewhere very close to the top of K2 at an elevation of 28,251 feet (8,611 m).</p>
<p>This is <strong>the second highest peak in the world</strong> and apparently Boris is on his way to conquer it, having misunderstood the name of the peak that the group of domainers was set to climb.</p>
<blockquote><p><em>&#8220;I feel sorry for Boris as we have some really great fire and we are roasting wild goats that can be found only on mount Kilimanjaro!&#8221;</em>, said Rick Latona, frantically warming up his hands. <em>&#8220;The local potatoes are also amazing, best food I&#8217;ve had since I left Atlanta, for sure!&#8221;, </em>he added with a smile.</p></blockquote>
<p><a href="http://domaingang.com/domain-news/winter-olympian-rick-latona-why-i-rode-a-bicycle-from-atlanta-to-vancouver/" target="_blank"><strong>The recent trip of Rick Latona via bicycle</strong></a> to Vancouver, Canada in order to deliver the Olympic torch for the Vancouver Winter Games of 2010 was a great warm-up for the Kilimanjaro expedition.</p>
<p>It remains to be seen how well Boris will do with the ascent of K2 &#8211; something that has never been achieved before this early in the year. Most climbers attempt to conquer K2 in June.</p>

<p>It was yet another slow-moving Friday night, the online crowd filled with newly-found energy reserved for the end of the week.</p>
<p>On the domain forums, lame domains for sale everywhere; twitter was crammed with the usual RT&#8217;s from boring, self-entertained individuals. Why did I bother to follow them in the first place, I wasn&#8217;t sure.</p>
<p>Outside, the night carried a hint of humid blossoms, a touch of vanilla, droplets of euphoria in nature&#8217;s own way.</p>
<p>Like the smell of a woman after sex.</p>
<p>She was messaging me, her voluptuous picture sharing a big smile with the rest of the world in every tweet. I only knew her stage name.</p>

<p>While one can register .com.pr, .net.pr and .org.pr domains for $100 bucks plus $50 per year thereafter, we chocked at the sighting of the registration and renewal fees for .pr domains.</p>
<p><strong><a href="https://www.nic.pr/fees.asp" target="_blank"><strong>Oh Dios mio! $1,000 bucks a year</strong></a>.</strong></p>
<p>Looks like an insane price to pay for all these benefits listed above. Those ingenious Puerto Ricans sell their virtual land with a hefty price tag.</p>

<p>It takes 45 days for the Internet provider to shut down his connection; by then, he has moved onto a new one.</p>
<p>Every afternoon, Ismail has coffee with his friends, Sadik and Usman, both students at the same Ankara University.</p>
<p>Sipping coffee from small cups, they tap on their laptops, connected through a wireless network of a nearby construction company. They hacked into the router using their own homegrown brute-force password cracker.</p>
<p><strong>Life is good.</strong></p>
<p>Ismail and his friends frequent domain forums and attempt to peddle their wares to people they call &#8220;stupid Americans&#8221;. Using hacked Paypal accounts, they quickly transfer money through debit cards and into cash.</p>
<p>Computer security in Turkey is lax at best; most often, large networks are compromised by their own administrators who resell user accounts for $10 a pop.</p>
<p>We got on AIM knowing we might get an odd taste of the East. Turkey&#8217;s small footprint on the European continent gives it a right in a future application for EU membership; still, most of the country occupies Anatolia and population lives in rather poor conditions.</p>
<p>The main Internet hubs run in Istanbul, Ankara and Izmir; most people living in these large metropolitan areas are driven by a motive to make money by any means possible, including fraudulent ones.</p>
