Belgian company won’t go Dutch; files #UDRP against DAN listed #domain

Belgian company MindWave cv chose to file a UDRP against Mindwave.eu, a domain registered in 2012, instead of buying it for 999 Euro.

The domain was listed for sale by its registrant on the Dutch domain platform, DAN.com. The decision favored the Respondent, and cost the Complainant at least $1,500 to file, not including administrative costs towards its corporate lawyers.

Mindwave was formed in 2019 in Athens, Greece, and operates from the domain Mindwave.com. Dot .eu domains are very popular in the European Union.

In summary, the WIPO panelist stated:

The Respondent has a legitimate interests in the disputed domain name as it has registered a domain name consisting of a dictionary expression six years before the Respondent came into existence and acquired trade name rights; and the Respondent has not registered and is not using the disputed domain name in bad faith.

Final decision: Deny transfer of the domain Mindwave.eu to the Complainant. The Respondent now has a unique opportunity to raise their asking price multi-fold.
