Costumes.com owner applies for matching trademark registration

Hong Kong based “Costumes.com Limited,” owners of the domain Costumes.com, have applied for the registration of the mark COSTUMES.COM with the USPTO.

The application lists the following products and services as related to the mark:

On-line retail store services featuring costumes, costume accessories, and apparel; On-line wholesale store services featuring costumes, costume accessories, and apparel

The trademark application cites date of first use in commerce September 17, 2021. It provides a screenshot of the active web site from Archive.org as a sample of use.

The domain Costumes.com was registered in 1995; it appears to be owned by Rubies.com, “the world’s largest designer, manufacturer and distributor of Halloween costumes and accessories.” We can speculate that they are separating their brand from other assets.

There are no records of a sale of the domain Costumes.com at NameBio.

Why was COSTUMES.COM applied for as a trademark at the USPTO?

 

It’s an ongoing trend among owners of generic domain names, following the decision by SCOTUS on the Booking.com trademark application.

Since then, dozens of generic domain names have been applied to be registered as trademarks, inclusive of the TLD.

As of January 5th, 2021, BOOKING.COM is a registered trademark with the USPTO.
