DiscountMemorials.com receives trademark registration at the USPTO

The operators of the domain DiscountMemorials.com have registered the matching mark, DISCOUNTMEMORIALS.COM, with the USPTO.

The mark was registered for the following services:

Online retail store services featuring memorial products, caskets, cremation urns, cremation jewelry, headstones, grave markers, cemetery products, funeral home products, cremation keepsakes, flag cases, memorial art, memorial statues, pet memorial products, pet caskets, pet cremation urns, pet cremation jewelry, pet cremation keepsakes, and pet memorial grave markers.

The date of first use of the mark is listed as October 12, 2021. The domain, however, was registered in 2014.

According to WHOIS records, DiscountMemorials.com was acquired from HugeDomains, where it was listed for sale until that date. It’s safe to assume that the sale involved an amount in the four figure range, as no domain that includes “memorials” exceeds $5,000 dollars at the HugeDomains database.

It’s worth noting that the time between the mark’s application and its registration was short, taking into consideration the current backlog at the USPTO that often exceeds six months until an application is assigned to an examiner.

It’s an ongoing trend among owners of generic domain names, following the decision by SCOTUS on the Booking.com trademark application.

Since then, dozens of generic domain names have been applied to be registered as trademarks, inclusive of the TLD.

As of January 5th, 2021, BOOKING.COM is a registered trademark with the USPTO.
