Eli Lilly & Co : Massive UDRP wins 368 ‘cialis’ domain names in one go!

This has to be one of the biggestmake that, massive – UDRP cases ever, with the ownership of 368 domains being decided in one go.

The case, filed by pharmaceutical corporation Eli Lilly and Company, addresses the ongoing phenomenon of trademark violation.

All of the domains contain the word “cialis“, the brand name of a medication used for erectile dysfunction.

It was filed against several Respondents and numerous email addresses, none of which bothered to respond.

According to this massive UDRP case:

“The CIALIS mark is used by Complainant and registered with the United States Patent and Trademark Office (“USPTO”) (e.g., Reg. No. 2,724,589, registered June 10, 2003) to identify its rights in a pharmaceutical product intended for the treatment of erectile dysfunction.

Respondent’s disputed domain names are confusingly similar to the CIALIS mark as they each incorporate the mark fully and merely add generic/descriptive terms such as: “pharmacy”, “cheap”, “online”, “generic”, “buy”, “pills”, and “order”, among others that are set out above. 

Further, the domain names also incorporate the generic top-level domain (“gTLD”) suffix “.com.”  “

We are not going to list the domains here, as they are top fodder for spam filters by Google! 😉
