SexToys.com: Adult #domain applies for the registration of the matching #trademark

CNVCOM LLC, operators of the domain name SexToys.com, have applied for the registration of the matching mark, SEXTOYS.COM.

The Las Vegas company cites as date of first use of the stylized mark to be April 29, 2022.

Clearly, this is a visual rebranding that ditches the old SexToys logo for a more clean, modern look and not a change in ownership.

As the application states:

The mark consists of a broken “X” shape formed by two curved lines, overlapping a broken cross shape formed by two curved lines, all appearing within a circle appearing to the left of the words “SEXTOYS.COM” in stylized font, the “X” in “SEXTOYS” appearing as a broken “X” shape formed by two curved lines.

SexToys.com is a domain registered in 1998; it’s very possible that it existed prior and it was allowed to lapse and get deleted. The owners of the domain also operate the singular, SexToy.com.

Why was the domain name SEXTOYS.COM applied for as a trademark with the USPTO?

It’s an ongoing trend among owners of generic domain names, following the decision by SCOTUS on the Booking.com trademark application.

Since then, dozens of generic domain names have been applied to be registered as trademarks, inclusive of the TLD.

As of January 5th, 2021, BOOKING.COM is a registered trademark with the USPTO.
