Drunken donuts : #USPTO application matches DD-sounding #domain owned by Mike Mann

A donuts company has applied for the registration of the trademark “Drunken Donuts.

There are some interesting tidbits about this application that we’d like to share.

The trademark application claims that first use of the mark occurred in late 2017, providing as specimen of use a business card with the company name.

At the same time, a trademark for WARM DRUNKEN DONUTS exists, which was registered in 2015 by a company in Delaware, unrelated to the applicant of this new mark.

And that’s not the only issue that we notice.

When Googling “Drunken Donuts” the top results want to redirect visitors to Dunkin’ Donuts. This doesn’t appear to be a coincidence; “drunken donuts” sounds quite a lot like “Dunkin’ Donuts.”

Meanwhile, the domain DrunkenDonuts.com is owned by Mike Mann‘s company, DomainMarket; the current asking price is a warm $9,888 dollars – and Mike Mann is definitely not drunk. 😀

Why would a business owner go ahead with a trademark application for a term, all while they don’t own the matching .com domain, is incomprehensible in this time and age.
