Exotic pets, such as bobcats, aren’t particularly popular – and yet, HugeDomains won a UDRP for the domain MyBocat.com on its generic nature.
Does one really own a bobcat – a feral carnivore feline – to call it “my bobcat?”
Some images from Google say yes.
But that’s not important in the eyes of the WIPO panelist, apparently; even if a handful of people are crazy enough to have a dangerous carnivore in their living room, that’s enough proof that the term “my bobcat” is a valid reference to an animal kept as a pet.
In a case brought forth by the Complainant, Clark Equipment, the Bobcat manufacturer cited a violation of its mark, as it’s been incorporated whole in the domain.
The Respondent fought back, stating that “bobcat” is a generic word and that Clark Equipment does not own every use of it.
Despite the domain being for sale for $2,795 and a registered trademark for Bobcat in use in commerce since 1958, HugeDomains won.
