Ventures Edge Legal PLLC, a Florida business legal services company, is seeking class certification in pending litigation against GoDaddy.com.
The company asked an Arizona federal judge last week to be given class certification.
Since 2014, GoDaddy.com allegedly failed to tell consumers that the Office 365 Business Premium plan it offered was a “watered-down” version of the one sold by Microsoft.
According to Law360.com:
“The Office 365 Business Premium plan sold by GoDaddy either provides the functionality in question or its does not – but the lack of functionality does not vary from class member to class member,” Ventures Edge said.
“Likewise, the click-through links that a consumer must visit to purchase Office 365 Business Premium from GoDaddy’s website either disclose the lack of functionality or they do not – but the disclosures do not vary from class member to class member.”
The lawsuit was filed in November 2015 and after some legal wrangling, the judge allowed it to proceed.
Class certification would involve potentially hundreds of thousands of class members, according to Ventures Edge.
