The SCOTUS decision on Booking.com made waves this summer, and Mattress Firm, Inc. is not sleeping.
The mattress giant operates the domain Sleep.com and filed for the SLEEP.COM trademark at the United States Patent and Trademark office.
The “intent to use” (ITU) application is listed as “Providing a website featuring information in the field of sleep; providing a website featuring information in the field of sleep products, namely, mattresses, mattress foundations, pillows, and adjustable bases for mattresses.”
Despite the open door that the Booking.com decision is providing to owners of generic domain names, this one is a bit different.
The SLEEP.COM application is for a figurative mark, where the letter “C” in the “COM” is formed by a crescent moon.

Registered in 1995, at a time when domain registrations were still free, Sleep.com was acquired by Mattress Firm, Inc., upon their acquisition of Sleepy’s. The latter is using a crescent moon for the apostrophe as their logo. Looks familiar?
