Prenup.com: New trademark application at the USPTO

HelloPrenup, Inc., operators of the premium domain, Prenup.com, have filed for the registration of the matching mark, PRENUP.COM, at the USPTO.

The mark was filed with an intend to use clause, and the mark consists of two interlocking rings with hearts above them to the left of “prenup.com”. The application involves the following services:

  • Attorney referral and matching services; Attorney referral services
  • Educational services, namely providing non-downloadable articles in the field of marriage, prenuptial agreements, and postnuptial agreements; educational services, namely classes, seminars, and workshops in the field of marriage, prenuptial agreements, and postnuptial agreements
  • Platform as a service (PAAS) featuring online computer software platforms for use in contract drafting, namely, software for user communication, agreement drafting, and uploading, storing, and maintaining messages, documents, images, and information; Software as a service (SAAS) services featuring software for user communication, agreement drafting, and uploading, storing, and maintaining messages, documents, and images for use in drafting prenuptial agreements; Software as a service (SAAS) services featuring software for providing information and pre-formulated questions for user review; Providing a website featuring technology that enables users to exchange messages and upload and share documents and images in the field of agreement drafting; Providing a secured-access, members only website featuring technology that gives members the ability to communicate and share data; Providing temporary use of on-line non-downloadable software and applications for document and image storage and exchange of messages
  • Legal services; legal advisory services; legal services in the field of prenuptial agreements; legal services in the field of postnuptial agreements

Registered in 1997, the domain name Prenup.com appears to be heavily under construction, as generic “filler” text is used on several segments.

Prenup.com appears to have changed hands in mid-December 2022, indicating that a sale took place. According to the trademark application, the mark’s owner appears to be Massachusetts attorney, Julia Rodgers, CEO & Co-Founder of HelloPrenup. One could say that the company will be performing a domain rebranding by acquiring Prenup.com.

Applying for the registration of matching marks is an ongoing trend among owners of generic domain names, following the decision by SCOTUS on the Booking.com trademark application.

Since then, dozens of generic domain names have been applied to be registered as trademarks, inclusive of the TLD.

As of January 5th, 2021, BOOKING.COM is a registered trademark with the USPTO.
