The Guardian is a famous publication in the UK, represented in this UDRP as Guardian News & Media Limited of London, United Kingdom of Great Britain and Northern Ireland.
UDRP cases against Yoyo Email Ltd, the notorious registrant of famous marks and brands in the dot .Email gTLD are pushing record numbers this year; the latest UDRP case annotates several of them, in a rather lengthy listing.
This time around, the culprit is the registration of the domain TheGuardian.Email by Yoyo Email Ltd, that used the same approach in defending its alleged business model.
“The Respondent also maintains that its business model is completely lawful under the UDRP and trade mark law. In this respect it claims that the Domain Name “is included in the declaratory relief requested by the United States District Court”. In this respect it provides an exhibit in the Arizonian proceeding brought against Playinnovation Limited identified above in the Factual Background section of this decision. The Domain Name does indeed appear to be included within the hundreds, if not thousands, of domain names that were initially identified in that litigation.”
Regardless, that Playinnovation case – as it was settled – has been refused by WIPO panelists to be a judgement affecting any other UDRP case with Yoyo Email Ltd. as the Respondent.
