#Chinese clipper maker applies for TOP COM #trademark registration

A Chinese clipper manufacturer has applied for the registration of the mark TOP COM at the USPTO.

TOPCOM Commodity Co., Ltd. of Guangzhou, China, applied for the mark for the following products:

Cuticle nippers; Cuticle pushers; Cuticle scissors; Cuticle tweezers; Emery boards; Eyelash curlers; Fingernail polishers, electric or non-electric; Hair-removing tweezers; Manicure sets; Nail clippers, electric or non-electric; Nail files; Nail scissors; Pedicure sets; Pocket shears.

The application cites July 20, 2020 as the date of first use. The mark consists of the stylized wording “TOP COM”.

The applicant appears to operate from an Alibaba store and as IVON from the domain topcomww.com.

In our opinion, this application has the potential of inciting confusion; the mark looks very close to the domain TOP.COM, which is parked at GoDaddy. The aged three letter .com domain appears to not be related to this application.

A similar trademark application involves the mark SHINE COM.

With the SCOTUS decision on the Booking.com case, many registrants of generic domain names have made an effort to secure the matching mark at the USPTO – hence the recently updated guidelines at the United States Patent and Trademark Office.
