Virtual Dental Care, Inc., operators of the domain name Dental.com, have applied for the registration of the matching mark, DENTAL.COM, with the USPTO.
The application involves a stylized design of a tooth segmented into three closed, curved shapes, appearing next to the wording “dental.com”. The mark was applied for with an “intent to use” clause, for the following services:
Providing a website with non-downloadable software for user access to dental care services, dental records, dental advice, dentist referrals, and identification, diagnosis, and treatment of, and consultation with respect to, dental conditions by dental health care providers; providing a website with non-downloadable software for scheduling dental visits between individuals and dental health care providers; providing a website with non-downloadable software for providing dental health care services via the Internet; providing a website with non-downloadable software for transmission of information in the nature of dental health services between and among individuals and dental health care professionals and payors; providing a website with non-downloadable software for acquiring images of individuals’ mouths and teeth.
The domain name Dental.com is one of the oldest in the .com database, with a registration date of September 8, 1993. The web site is currently in development; the domain was most likely acquired on or around August 28, 2020. Oddly, there are no records of it on Archive.org until 2006, a full 13 years after its registration and the majority of the archived pages point to PPC/parking pages.
The current owners are most likely operated by Teledentix, a software company in California.
Why was the domain name DENTAL.COM applied for as a trademark with the USPTO?
It’s an ongoing trend among owners of generic domain names, following the decision by SCOTUS on the Booking.com trademark application.
Since then, dozens of generic domain names have been applied to be registered as trademarks, inclusive of the TLD.
As of January 5th, 2021, BOOKING.COM is a registered trademark with the USPTO.
