A company that uses the term ‘sexy Japanese‘ to provide educating courses in the Japanese language, registered the mark ‘Sexy Japanese’ with the trademark office of Latvia.
The mark was registered last October, and the Complainant went after the domain name SexyJapanese.com, registered in 1998.
Despite the Complainant’s allegation that the domain only became property of the Respondent in August 2014, that alone does not override the fact that the trademark was registered after the Respondent acquired the domain.
One would expect that such an obvious case would be tagged with a finding of Reverse Domain Name Hijacking, however, this must be explicitly requested by the Respondent, and that wasn’t the case.
The sole panelist, John J. Upchurch, ordered the domain SexyJapanese.com to remain with the Respondent.
