Missouri-based Misterbator LLC, operators of the domain name Misterbator.com, have applied for the registration of the matching mark, MISTERBATOR.COM, with the USPTO.
The application denotes that the mark consists of the silhouette of a man in a suit and tie with his hands in his pockets. There are the words “MisterBator.com” is located thigh high with the letters “Miste” overlaying the silhouette.
As it is obvious, the word “misterbator” is a play on the word masturbator; this all makes sense, as the applicant intends to sell “Sex Toys For Men.”
Creative names are usually easier to register as trademarks than generic words, as the latter require a secondary meaning for the keyword.
Registered in 2021, the domain name Misterbator.com displays a landing page with minimal information on the “Misterbator” business and project.
Applying for the registration of matching marks is an ongoing trend among owners of generic domain names, following the decision by SCOTUS on the Booking.com trademark application.
Since then, dozens of generic domain names have been applied to be registered as trademarks, inclusive of the TLD.
As of January 5th, 2021, BOOKING.COM is a registered trademark with the USPTO.
