Baskin-Robbibns is a registered trademark, going all the way back to 1954 in connection with the operation of ice cream parlors, restaurants, and the sale of related products.
The company operates from BaskinRobbins.com and there is no doubt that their menu is delicious.
Along with the expansion of the Internet name space, the proliferation of new gTLDs has brought along an inadvertent number of trademark violations.
This was clearly the case with the domain name, BaskinRobbins.menu, that was taken to the National Arbitration Forum on behalf of the Complainant, BR IP Holder LLC.
Was its Canadian registrant planning to create some sort of ice cream menu, unaware of the trademark in question? Regardless of their intentions, they never respondent to the UDRP.
The sole panelist of the case, Neil Anthony Brown, was perfectly clear about the case, with one exception: due to some apparent copy/pasting, they listed the domain “Priceline.com” at the very end of the decision. ๐
