When you sign up for an affiliate service – regular or adult related – stay away from variations of the provider’s name and trademark.
Wanting to be close to the source of the revenue stream can be tempting and financially rewarding at first, but can lead to a devastating loss eventually.
That’s exactly what happened to an affiliate of PornTube, Calista Enterprises.
They registered 13 domains, each one containing the PornTube mark:
LargePornTube.com, GoldPornTube.com, KissPornTube.com, BoxPornTube.com, PipePornTube.com, 69PornTube.com, RoyalPornTube.com, BookPornTube.com, CubePornTube.com, FreshPornTube.com, LustPornTube.com, BonusPornTube.com and DirectPornTube.com.
PornTube paid to Calista more than $132,140 over a period of 20 months for its services, through the affiliate program, according to records.
Not only did Calista Enterprises lose its affiliate income, they also lost the domain names, as the National Arbitration Forum decided in favor of PornTube, with two panelists for and one against.
Moral of the story: don’t piss where you kiss.
nice story but your conclusion makes no sense. so they spent about a hundred dollars on domain names and only got back 132,000 in 20 months. what fools they must be.
RaTHeaD – The UDRP is just the tip of the iceberg. There are pending lawsuits; Calista wants to have PornTube’s trademark canceled as generic. Essentially, it’s a pissing contest.
