Sarah Palin’s Trademark application gets refused – Domain not used

An obviously fake but hot picture of Sarah Palin.

You’d expect better organizational skills from a person who aspired to be Vice President of the United States of America.

Former VP candidate and former Alaska governor, Sarah Palin applied for a trademark for her namesake, “Sarah Palin” back in November of 2010.

The controversial Republican filed for a trademark for the following classes:

IC 035. US 100 101 102. G & S: Information about political elections; Providing a website featuring information about political issues. FIRST USE: 19960101. FIRST USE IN COMMERCE: 19960101

IC 041. US 100 101 107. G & S: Educational and entertainment services, namely, providing motivational speaking services in the field of politics, culture, business and values. FIRST USE: 19960101. FIRST USE IN COMMERCE: 19960101

We are not sure exactly what type of web site content was Sarah Palin providing in 1996. She registered SarahPalin.com in 2004 and the Wayback Machine of Archive.org shows that nothing has been in place as late as 2006.

So was Sarah Palin fibbing about the “first use” or was it a mistake by her advisors?

Regardless, her application with the USPTO was denied, on the basis of lacking her very signature! 😀

Amazing as it may sound, the USPTO response reads as follows:

Registration is refused because the applied-for mark, SARAH PALIN, consists of a name identifying a particular living individual whose consent to register the mark is not of record.  […]

The examining attorney notes the applicant is Sarah Palin, the name specified as the mark.  However Ms. Palin did not personally sign the application.  As stated in TMEP section 106.04(b):

Application Must be Personally Signed. Consent may be presumed only where the individual whose name or likeness appears in the mark personally signs the application. If the application is signed by an authorized signatory, consent to register the name or likeness must be obtained from the individual. This is true even where the name or likeness that appears in the mark is that of the individual applicant.

Please note this refusal will be withdrawn if applicant provides written consent from the individual identified in the applied-for mark.

In other words, Sarah Palin didn’t put her name to the paperwork. But she claims she can see Russia from her back yard in Alaska? 😀
