An obviously clueless domainer, who has listed the domain name DisneyFamily.org for sale on Flippa, is confident about the value of his asset.

Says the misinformed owner:

“…the word “Disney” is not trademarked or copyrighted. The Disney corporate logo and/or graphics is. As long as the new owner doesn’t violate any trademark or copyright laws, there will be no problems.”

He then claims that a everything has been cleared by an attorney:

“Your concerns would be quickly resolved with a consultation with a internet trademark attorney.”

Sorry to bust your bubble there, but not only is Disney a trademark, it’s a famous one. It’s like Apple, Microsoft, Xerox and BMW.

There are plenty of registered trademarks for “Disney” at the USPTO, unlike what the seller claims, so here’s one and here’s another.

Just how would someone use this domain anyway?

Unless your last name is “Disney“, forget about it: that’s what Screenshots.com has captured it to operate in 2008.

That, might be borderline acceptable, although one would expect a call or two from Disney HQ lawyers. And what if your name isn’t Disney?

The problem is, the seller clearly promotes the domain’s use as a portal/blog offering products and services related to Disney(tm) and that’s something no IP attorney that has passed the bar in California or Florida would be supporting.

    Disney comes from the name “Walt Disney”. So Disney is somebody’s last name, and I assume not only of 1 man. Therefore, it is not nearly the same as Apple, Microsoft, Xerox and BMW.

    DisneyFamily is legitimate domain name if John, Jerry, James, Warren (etc) Disney wants to use it.

    The seller is selling the domain on the pretext of Disney product & service popularity. I don’t know many people by that last name, and it surely is one god-damn famous mark, unlike what the seller claims.

    It’s ok being clueless, but spreading misinformation is another thing. I suggest you do some strenuous reading on trademark basics.
