A rare automatic finding of Reverse Domain Name Hijacking was delivered in a case where the Complainant, an Argentinian accounting firm, tried to wrestle a domain away from a Mexican Bank established more than 100 years ago.
The RDNH finding was not initiated by the Complainant and it’s thus automatic; the sole panelist, Dennis A. Foster, based his decision on the lack of any facts presented by the Complainant, who also broke protocol by promising further evidence instead of providing it.
It was clearly a slam-dunk case, where the Complainant, Soluciones Contables S.A. of Buenos Aires, claimed that its Argentinian common law mark, “CUENTAS EN LINEA BAIREX”, was infringed upon by the Bank’s domain name, CuentasEnLineaBanamex.com.
The Bank, Banco Nacional de Mexico of Medellin, Mexico, actually owns registered marks for “Banamex”. Furthermore, unlike what the Complainant asserted, “Bairex” does not look or sound anything close to “Banamex.”
The end result: Mexico 1 – Argentina 0.
