The business plan of Yoyo Email Ltd., a British company that registered several thousand dot .Email domains, has yet to be disclosed.
Setting a record number of UDRP cases in 2014, Yoyo Email Ltd. is notorious for the absurdity of its domain registrations: they match famous trademarks.
In the latest UDRP at the WIPO, Amazon.com, Inc. prevailed against Yoyo Email Ltd. for the domain name AmazonSupport.Email.
An average person would presume the domain is somehow endorsed by Amazon, and the panelist in this case stated exactly that:
“The Disputed Domain Name includes the word “support” in addition to the AMAZON Mark. The inclusion of “support” does nothing to avoid a finding of confusing similarity, as numerous previous panels have found. Indeed, the inclusion of the world “support” actually may increase the confusing similarity because the term “support” describes the customer support services associated with Complainant’s products. Therefore, the Panel finds that the Disputed Domain Name is confusingly similar to the AMAZON Mark pursuant to the Policy, paragraph 4(a)(i).”
The Respondent rehashed previous statements, alleging non-infringement of the mark, and stating that they will “soon be performing a service of certifying receipt of email for the benefit of both the sender and the recipient.”
Richard W. Page, sole panelist, found that the Complainant has shown sufficient facts to support a finding that AmazonSupport.Email was registered and used in bad faith, thus ordering it to be transferred to Amazon.com, Inc.
