Looks like AuntJemina.com is going to get some sweet value

With PepsiCo dropping the Aunt Jemima brand, the existing trademark for AUNT JEMIMA is most likely going to become obsolete.

Alongside the domain name, AuntJemima.com, the brand will serve as a historic relic and a URL forwarder.

Someone, however, has plans for AUNT JEMINA and they’ve applied for a trademark:

Pancakes; Pancake mixes; Pancake syrup; Frozen pancakes; Frozen flour-free foods, namely, pancakes, crepes, sandwich wraps, muffins and griddle cake sandwiches which are protein-enriched; Frozen flour-free foods, namely, waffles, pancakes, crepes, sandwich wraps, muffins and griddle cake sandwiches which are protein-enriched; Frozen pancake batter; Green onion pancake (pajeon); Instant pancake mixes; Kimchi pancakes; Mung bean pancakes (bindaetteok); Pre-mixed pancake batter; Savory pancake mixes; Savory pancakes; Savoury pancake mixes; Savoury pancakes

That brings back to life the apparent typo-domain, AuntJemina.com, registered in 2005. The letters “M” and “N” are sitting next to each other on the keyboard, so the domain is surely getting quite a bit of traffic meant for AuntJemima.com.

It’s going to be an interesting case, if the trademark applicant gets a registration going, but what if PepsiCo opposed it?

    well in order to maintain a tm on the principal register. You have to use the tm in commerce. So if Pepisco is dropping the name aunt Jemima
    there will be no use in commerce. Therefore the name aunt Jemima cannot remain a registered tm. After I believe 3 yrs the new aunt jemina tm can file a notice of opposition as the name has failed to maintain tm status.

    This is the type of question tm attorneys should be answering. And once again these tm attorneys are useless. They just want to be paid 350.00 an hr for work that is worth less than 100.00 dollars an hour.
