In one of the funniest UDRP filings that we’ve seen in a while – although we don’t go through as many as Domain Name Wire does – Philip Morris USA Inc. “smoked out” the registrant of a domain at the National Arbitration Forum.

There is no doubt that smoking causes cancer, and yet, millions of smokers around the world prefer to die a slow, agonizing death. In the meantime, tobacco companies like Philip Morris USA Inc. create and promote brands such as the Marlboro cigarettes, well-known for its iconic cowboy.

Philip Morris USA Inc. went after the registrant of the domain name, MarlboroSucksBalls.com, registered in March of this year.

Unfortunately for the Respondent of this UDRP, they lost their opportunity to create a web site reflecting their true sentiment and that of millions of others towards the marketers of death. Such criticism is protected by the 1st Amendment in the United States.

Does Marlboro suck balls? Most definitely, just like every other cigarette brand.

In cases such as these, it’s a good idea to launch the web site as soon as the domain is registered, otherwise the placement of parked content or even ads will diminish your chances of keeping the domain active.
