Returned.com operators file for the registration of the matching trademark

Returned.com, Inc., operators of the premium domain name Returned.com, have filed for the registration of the matching mark at the USPTO.

The mark consists of a reverse white double chevron shape within a teardrop shape of contrasting color, above the words “Returned.com” wherein “Returned” is large and horizontal and “.com” is smaller and vertical.

The application was filed in 4 distinct classes, for the following products/services, with an intent to use (ITU) clause:

  • Downloadable software for accepting and processing product returns, exchanges and refunds; downloadable application programming interface (API) software; downloadable software for the provision of a platform for accepting and processing product returns, exchanges and refunds; downloadable mobile applications for accepting and processing product returns, exchanges and refunds; Downloadable computer software for tracking and managing ongoing personal subscriptions, membership accounts, and service accounts.
  • Return management services, namely, management of returned merchandise; business management services, namely, managing the exchange of goods for others; online tracking for others of product returns, exchanges and refunds for cost accounting and inventory management purposes; business data analysis; data collection and data management relating to shipping, verification, return, and exchange of consumer products; business information services provided to retailers and vendors for use in product return management, validation of product return eligibility, product authentication, and retailer product return policies; inventory management services for others.
  • Supply chain logistics and reverse logistics services, namely, coordinating and facilitating the storage, transportation, shipping and delivery of goods for others by air, rail, ship or truck.
  • Software as a service (SAAS) services featuring software for accepting and processing product returns, exchanges and refunds; providing temporary use of non-downloadable software for accepting and processing product returns, exchanges and refunds; Software as a service (SAAS) services featuring software for processing electronic payments, authorizing financial transactions, managing and tracking electronic payment information and facilitating e-commerce services for others, namely, for allowing users to perform electronic business transactions via a global computer network; Software as a service (SAAS) featuring software for tracking, monitoring, and analyzing return analytics, user behavior, and customer satisfaction; application service provider featuring application programming interface (API) software; Platform as a service (PAAS) featuring software for accepting and processing product returns, exchanges and refunds; providing temporary use of online, non-downloadable financial software platforms for facilitating financial transactions to enable a customer to purchase, return, or exchange goods; Software as a service (SAAS) services featuring software for tracking and managing ongoing personal subscriptions, membership accounts, and service accounts.

The domain name Returned.com was registered in 1999 and for most of its life it was either parked or with an under construction message, the exception being this Archive.org capture from 2008.

The capture cites James L. Marciano as the domain’s owner at the time, although it was listed “for sale” along with other domains: mailtoll.com, emailtoll.com, oldemail.com,oldemailaddress.com, returned.com, undeliverable.com, greenhomeclub.com and thegreenhomeclub.com, oxygen.md, and rematch.com and re-match.com.

Currently, Returned.com displays a message prompting visitors to enter their email address and get notified when the site launches. The latest update to the domain records of Returned.com took place in early 2023.

Applying for the registration of matching marks is an ongoing trend among owners of generic domain names, following the decision by SCOTUS on the Booking.com trademark application.

Since then, dozens of generic domain names have been applied to be registered as trademarks, inclusive of the TLD.

As of January 5th, 2021, BOOKING.COM is a registered trademark with the USPTO.
