Chill.com: CBD company files to register the matching trademark at the USPTO

Chill CBD Pouches & Smokes acquired the domain Chill.com earlier in the summer. The acquisition took place with the assistance of Tessa Holcomb of Domain Advisors, who shared the news at the time:

“Thrilled to announce the sale of Chill.com now poised to support the growth of a global brand who believes that, “Taking time to chill through the stresses of life makes communities that are strong, healthy and creative.” Not only a fun name to work on but great people to work with on all sides.”

Colorado-based Zoetic Corporation has now filed for the registration of the matching trademark, CHILL.COM. The mark consists of standard characters, without claim to any particular font style, size, or color. The application was filed with the USPTO with an “intent to use” clause, all while citing a recent application with the European Union Intellectual Property Office.

That application is pending for the following products and services:

Pharmaceutical preparations; sanitary preparations for medical purposes; dietetic substances adapted for medical use; dietary supplements and dietetic preparations; dental preparations and articles, and medicated dentrifices; sanitary preparations and articles; Hemp oil containing CBD derived from hemp; herbal tinctures for medical purposes; hemp extracts; dietary and nutritional supplements containing hemp oil; dietary supplements and dietetic preparations containing CBD oil; medicated lotions for skin, face, hands, and body; herbal topical creams, salves, and ointments for the relief of aches and pain, all of the foregoing containing hemp oil; natural supplements for treating anxiety; supplements for treating anxiety in the form of oral sprays, mints, and dissolvable strips; oral sprays, mints, and dissolvable strips containing CBD derived from hemp; natural remedy preparations for the treatment of anxiety; food supplements; soft gels, namely pharmaceutical capsules and capsules for natural remedies.

Herbal cigarettes; hemp cigarettes; hemp cigarettes containing cbd; herbal pouches; hemp derived cbd pouches; vaporizer pen refill cartridges; vaporizer pen refill cartridges sold empty; cartridges sold filled with hemp derived cbd oil for vaporizer pens; snuff; smokers’ articles included in Class 34; none of the aforesaid services in relation to absorbent paper for tobacco pipes, books of cigarette papers, cigarette paper and pocket machines for rolling cigarettes.

Retail store services in relation to herbal cigarettes, hemp cigarettes, hemp derived cbd pouches, vaporizer pen refill cartridges, soft gels, beverages and hemp flower plants.

It’s definitely an interesting method to establish priority in the application with the USPTO.

Why was CHILL.COM applied for as a trademark at the USPTO?

It’s an ongoing trend among owners of generic domain names, following the decision by SCOTUS on the Booking.com trademark application.

Since then, dozens of generic domain names have been applied to be registered as trademarks, inclusive of the TLD. We keep track of these applications, and so far none has been decided upon.

As of January 5th, 2021, BOOKING.COM is a registered trademark with the USPTO.
