DSW Shoe Warehouse, Inc., operators of the domain name ShoeBuy.com, have filed for the registration of the matching mark, SHOEBUY.COM, at the USPTO.
The application is an “intent to use” filing, for an “On-line retail store services featuring headwear and footwear.”
In early 2017, Jet, through its parent Walmart, acquired ShoeBuy from IAC for approximately $70 million. Four years later, Walmart sold the assets to Israeli apparel maker Delta Galil Industries along with Shoes.com.
The domain ShoeBuy.com forwards to Shoes.com. Last week, we shared news of Sales.com being sold, once again, to Designer Brands. DSW is the mother company of Designer Brands and are the ones applying for the trademark registration of ShoeBuy brand.
Why was SHOEBUY.COM applied for as a trademark at the USPTO?
It’s an ongoing trend among owners of generic domain names, following the decision by SCOTUS on the Booking.com trademark application.
Since then, dozens of generic domain names have been applied to be registered as trademarks, inclusive of the TLD.
As of January 5th, 2021, BOOKING.COM is a registered trademark with the USPTO.
